Art & Nature Apartments Bad Vilbel — for the rental of apartments / holiday accommodation
1. Scope
These Terms and Conditions apply to all contracts for the temporary rental of apartments, holiday flats or other accommodation by Art & Nature Apartments Bad Vilbel to guests, as well as for all related services. Deviating conditions of the guest do not apply unless Art & Nature Apartments Bad Vilbel expressly agrees to their validity in text form. These T&C apply both to direct bookings via the website, by email, by phone or in person, and additionally to bookings made via booking platforms, insofar as no deviating provisions have been agreed there.
2. Contracting parties and conclusion of contract
The contracting parties are Art & Nature Apartments (Dortelweiler Straße 29, 61118 Bad Vilbel) and the respective guest. The accommodation contract is concluded as soon as Art & Nature Apartments Bad Vilbel confirms the guest's booking in text form, for example by email, or once the booking has been bindingly accepted via a booking system. If one person books on behalf of additional guests, that person is liable for all contractual obligations of the accompanying guests, insofar as they have assumed a corresponding obligation or as required by statutory provisions. Art & Nature Apartments Bad Vilbel is entitled to reject booking requests without giving reasons.
3. Services and use of the accommodation
Art & Nature Apartments Bad Vilbel provides the guest with the booked accommodation for the agreed period and to the agreed extent. The accommodation may only be used by the registered persons. Subletting, transfer to third parties or use for purposes other than accommodation is not permitted without prior consent from Art & Nature Apartments Bad Vilbel. Parties, events, commercial use, photo and film productions and similar uses require prior consent in text form. The guest has no entitlement to a specific accommodation unit unless a specific unit has been expressly confirmed. Art & Nature Apartments Bad Vilbel is entitled to provide an equivalent or higher-grade replacement, provided this is reasonable for the guest.
4. Prices and scope of services
The prices agreed at the time of contract conclusion apply. All prices stated to consumers include the applicable statutory VAT and any mandatory price components, insofar as these are known at the time of contract conclusion. Optional services such as breakfast, parking, additional cleaning, pets, baby cot, late departure or other extras are listed and charged separately, unless they are expressly included in the booked price. If the guest changes the period of stay, the number of guests or the scope of the booked services after the contract is concluded, the price may change accordingly.
5. Payment, deposit and security
The agreed total price is due at the latest upon arrival, unless a different payment deadline has been agreed in advance or stated in the booking confirmation. Art & Nature Apartments Bad Vilbel may request a deposit. The amount and due date of the deposit are communicated to the guest before the contract is concluded. Payments can only be made by bank transfer, cash or PayPal. In case of late payment, Art & Nature Apartments Bad Vilbel is entitled to claim default interest and reminder costs in accordance with statutory provisions. Art & Nature Apartments Bad Vilbel may request a security. Amount, payment method and due date are communicated to the guest before contract conclusion. The security is refunded after departure and inspection, provided no outstanding claims, damages or other charges exist.
6. Arrival and departure
Check-in is possible from 5:00 PM or by prior arrangement. Check-out must be completed by 10:00 AM on the day of departure at the latest, unless otherwise agreed. Earlier arrival or later departure is only possible with prior consent and may incur additional charges. If the guest does not arrive on the day of arrival or arrives significantly late, the right to remuneration of Art & Nature Apartments Bad Vilbel remains in accordance with the cancellation provisions. Late departure without consent may incur additional charges. Further damages remain reserved.
7. Cancellation, no-show and early departure
Free cancellation is possible up to 30 days before the agreed arrival date, unless deviating conditions have been agreed in the booking confirmation. For bookings via booking platforms, supplementary or deviating cancellation conditions may apply if they have been validly incorporated into the contract.
8. No statutory right of withdrawal for fixed accommodation periods
For contracts for accommodation purposes other than residential, there is generally no statutory right of withdrawal under § 312g (2) No. 9 of the German Civil Code (BGB) if the contract provides for a specific date or period of performance. Therefore, only the contractually agreed cancellation conditions apply, unless a statutory right of cancellation or termination exists.
9. House rules, quiet hours, no smoking and pets
The guest undertakes to comply with the house rules of Art & Nature Apartments Bad Vilbel. The house rules form part of the contract insofar as they have been made available to the guest before or at the conclusion of the contract. Statutory and house quiet hours must be observed. Other guests, neighbours and residents must not be unreasonably disturbed. Smoking is not permitted in the apartments and indoor areas, unless expressly indicated otherwise. In case of violations, additional cleaning, refurbishment and loss-of-use costs may be charged. Pets are only permitted with prior consent. The guest is liable for all damages caused by pets and additional cleaning costs.
10. Guest obligations
The guest must treat the accommodation, inventory, communal areas and technical equipment carefully and as intended. Damages, defects, disturbances or losses must be reported to Art & Nature Apartments Bad Vilbel without delay so that remedies can be arranged. The guest must close windows and doors when leaving the accommodation, use heating, water and electrical appliances reasonably, and observe fire safety regulations. The guest must leave the accommodation in an orderly condition upon departure. Excessive soiling, undisposed waste or unagreed special cleaning may be charged additionally.
11. Damages, key loss and guest liability
The guest is liable for damages caused culpably by them, their fellow travellers, visitors or pets. In the event of loss of keys, key cards, transponders or other access tools, the guest bears the necessary costs for replacement and, if required for security reasons, for replacing the lock or access systems. Art & Nature Apartments Bad Vilbel may offset damages, missing inventory, special cleaning and other legitimate claims against any deposit. Further claims remain reserved.
12. Liability of Art & Nature Apartments Bad Vilbel
Art & Nature Apartments Bad Vilbel is liable for damages resulting from injury to life, body or health in accordance with statutory provisions. For other damages, Art & Nature Apartments Bad Vilbel is only liable in the event of intent or gross negligence. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the guest may regularly rely. Liability for items brought in is governed by statutory provisions. Further liability exists only insofar as Art & Nature Apartments Bad Vilbel is responsible for the damage. For service disruptions due to force majeure, official orders, natural events, power, water or internet outages outside the area of responsibility and similar events, Art & Nature Apartments Bad Vilbel is only liable in accordance with statutory provisions.
13. Withdrawal by Art & Nature Apartments Bad Vilbel
Art & Nature Apartments Bad Vilbel is entitled to withdraw from the contract or to terminate it extraordinarily if the guest fails to make due payments despite reminders, provides false personal information or false information regarding the number of guests, uses the accommodation contrary to contract or significantly violates the house rules. Withdrawal or termination is also possible if the provision of the accommodation becomes impossible or unreasonable for reasons not attributable to Art & Nature Apartments Bad Vilbel, for example fire, water damage, official orders, force majeure or comparable events. In the event of justified withdrawal for reasons attributable to the guest, the right to the agreed remuneration remains in accordance with statutory provisions. Further claims remain reserved. Payments already made will be refunded to the extent that no payment claim of Art & Nature Apartments Bad Vilbel exists.
14. Data protection
Art & Nature Apartments Bad Vilbel processes the guest's personal data exclusively in accordance with applicable data protection regulations. Further information on the processing of personal data, on the rights of data subjects and on the contact details of the responsible party is provided in the privacy policy on the website of Art & Nature Apartments Bad Vilbel.
15. Consumer dispute resolution
Art & Nature Apartments Bad Vilbel is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless there is a statutory obligation in individual cases.
16. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the guest has their habitual residence remain unaffected, insofar as these are applicable. Should individual provisions of these T&C be wholly or partially invalid or become invalid, the validity of the remaining provisions remains unaffected. Statutory provisions apply in place of the invalid provision. Amendments and supplements to the contract require text form, insofar as legally permissible. This also applies to amendments to this text-form clause. Place of jurisdiction is, insofar as legally permissible, the registered office of Art & Nature Apartments Bad Vilbel.
